D1. What this service is

D1.1 A fixed or mobile wireless data service delivered over a third-party mobile network. Active Fibre currently resells services on the MTN and Telkom networks. Your package states which network carries it.

D1.2 The service requires a SIM and a compatible router. Only routers approved by the underlying network may be used.

D2. No speed or coverage guarantee

D2.1 LTE and 5G are best-effort services. We give no warranty, representation or guarantee — express or implied — as to speed, throughput, latency, network capacity, coverage, availability, reliability or security.

D2.2 Advertised speeds are maximum speeds. Actual speed depends on your location, distance from and load on the base station, the tower's backhaul, your device and router, weather, building materials and network congestion.

D2.3 Coverage is not guaranteed. Coverage maps are indicative only and are the network operator's. Outside a coverage area, or in a location with poor signal, you may receive an impaired service or no service at all. We are not responsible for the quality of the service received, or for the service ceasing to be available at your location.

D2.4 There is no service level agreement and no service credits for this service.

D2.5 The SIM is locked to the first base station it registers on. Attempting to use it elsewhere may result in the SIM being blocked, and a SIM swap charge applies.

D3. Fair use — MTN packages

D3.1 MTN Uncapped Premium: up to 25Mbps. D3.2 MTN Uncapped Lite: up to 10Mbps, with all real-time entertainment, video and music streaming capped at 4Mbps at all hours. D3.3 On both, peer-to-peer, NNTP and newsgroup traffic is throttled to 128kbps at all hours. D3.4 Capped packages: data is valid for 1 month and unused data carries over for one additional calendar month only. Usage notifications are sent at 50%, 80% and 100% of the base allocation.

D4. Fair use — Telkom packages

D4.1 Telkom Unlimited LTE packages are subject to Telkom's published Fair Usage Policy:

D4.2 Thresholds reset monthly; packages carry 1 month validity. D4.3 20Mbps Daytime operates between midnight and 19:00 only. A once-off data bundle may be purchased to use the service between 19:01 and 23:59. D4.4 Telkom treats peer-to-peer and NNTP (news server) protocols as excessive bandwidth-intensive protocols and reserves the right to terminate the account of a customer whose usage compromises network performance, without warning.

D4.5 These thresholds are set by the network operator and may change without notice to us. The current published policy of the relevant operator applies.

D5. Term and cancellation

D5.1 LTE and 5G services are provided month-to-month.

D5.2 Cancellation requires one (1) Calendar Month's written notice to accounts@activefibre.co.za. Cancellations are processed for month-end; pro-rata does not apply on cancellation.

D5.3 Where the underlying network imposes a longer commitment on us, Active Fibre carries that commitment — you are not charged for the balance of any network contract term when you cancel in accordance with clause D5.2.

D5.4 Pro-rata billing applies in the month a package is activated, for both data and price.

D5.5 Billing continues at the fixed monthly rate for active and suspended accounts.

D6. SIM, RICA and equipment

D6.1 You must complete RICA registration before the SIM can be activated, and must provide proof of identity and address. We may withhold or suspend the service if RICA requirements are not met.

D6.2 Routers supplied carry a 12-month warranty. A free replacement is conditional on the original packaging and a matching IMEI.

D6.3 Router and SIM remain our property unless purchased outright (see Master Services Agreement clause 9).

D7.1 A maximum of two delivery attempts will be made. An order is automatically cancelled after four failed attempts to contact you.
