H1. What this service is

H1.1 Hosted email mailboxes on your domain, including webmail and standard IMAP, POP and SMTP access, with the mailbox count and storage stated in your package.

H1.2 Where your Order is for a third-party email platform (such as Microsoft 365), that vendor's own terms also apply to you, and the service is subject to the vendor's availability, support and data-handling terms.

H2. Best effort — no uptime commitment

H2.1 Email hosting is provided on a best-effort basis. We do not guarantee uptime, availability, or that email will be delivered, received or stored without interruption, delay or loss. There is no service level agreement and no service credits.

H2.2 Email delivery depends on parties outside our control — recipient servers, spam filters, blocklists and upstream relays. We cannot guarantee that a message you send will be accepted or delivered, or that a message sent to you will arrive.

H3. Backups and data

H3.1 You are responsible for your own email backups. Where mail is left on the server, you should keep a local copy or an independent backup.

H3.2 Any platform backups we take are a courtesy for our own disaster recovery. We do not guarantee a backup exists, is current, or can be restored, and we may charge for restore assistance.

H3.3 We are not liable for the loss, deletion or corruption of email, however caused, to the fullest extent permitted by law.

H3.4 On termination, mailboxes and their contents may be permanently deleted. Export everything you need before the service ends.

H4. Spam, sending limits and reputation

H4.1 You must not send unsolicited bulk or commercial email from the service. This includes purchased or harvested lists. Marketing mail must comply with section 45 of the Electronic Communications and Transactions Act 25 of 2002 and with POPIA's direct-marketing rules.

H4.2 We apply sending limits per mailbox and per account to protect platform reputation. Bulk or campaign mail must be sent through a dedicated bulk-mail provider, not this service.

H4.3 We may immediately suspend a mailbox or account that is compromised, is sending spam or malware, or is causing the platform to be blocklisted. You must secure your mailboxes and use strong, unique passwords; we recommend enabling multi-factor authentication where available.

H4.4 We are not liable for the consequences of blocklisting, whether of your domain, your IP or the shared platform.

H4.5 We apply spam and virus filtering on a reasonable-endeavours basis. Filtering is not perfect: legitimate mail may be quarantined and unwanted mail may be delivered. You should check quarantine regularly.

H5. Term and cancellation

H5.1 Email hosting is provided month-to-month, unless your Order records a fixed term for a third-party platform licence (for example an annual Microsoft 365 commitment), in which case that term applies and early termination is governed by clause 4.1 of the Master Services Agreement.

H5.2 Cancellation requires one (1) Calendar Month's written notice to accounts@activefibre.co.za.

H5.3 Suspended accounts continue to be billed. Reactivation attracts the R79.99 fee.

H6. Your responsibilities

H6.1 You are responsible for the content of email sent from your account, for your users' conduct, and for compliance with the Acceptable Use Policy.

H6.2 You are the Responsible Party under POPIA for personal information in your mailboxes.
